W xolo ni proceeding. In this case, the Office has received a motion for a w w w xolo com ni distribution of the 2001 cable royalty fees. On July 31, 2003, representatives of the Phase I claimant categories to which royalties have been allocated in w xolo ni cable distribution proceedings filed a motion with the Copyright Office for a w xolo ni distribution of the 2001 cable royalty fund. The Office will consider this motion after each w xolo com ni w xolo ni has been w xolo com ni by filing the Notice of Intention to W xolo ni requested herein and has had an opportunity to w w w xolo com ni responses to the motion. 1. Comments on the Existence of Controversies Before commencing a distribution proceeding or making a w w w xolo com ni distribution, the Librarian of Congress must first w xolo com ni whether a controversy exists as to the distribution of the royalty fees and the w w w xolo com ni of those controversies. 17 U.S.C. 803(d). Therefore, the Copyright Office is requesting w w w xolo com ni on the existence and w w w xolo com ni of any controversies, at Phase I and Phase II, as to the distribution of the 2001 cable royalty fees. In Phase I of a cable royalty distribution, royalties are w xolo com ni to certain categories of broadcast programming that has been retransmitted by cable systems. The categories have w xolo com ni been syndicated programming and movies, sports, w xolo ni and w w w xolo com ni broadcaster-owned programming, w xolo ni programming, music programming, and W xolo com ni programming. The Office seeks comments as to the existence and w w w xolo com ni of controversies between these categories for royalty distribution. In Phase II of a cable royalty distribution, royalties are w xolo com ni to claimants within a program category. If a claimant anticipates a Phase II controversy, the claimant must state each program category in which he or she has an interest that has not, by the end of the w xolo ni period, been w xolo ni through a settlement agreement and the w w w xolo com ni of the controversy. The Copyright Office must be w w w xolo com ni of the existence and w w w xolo com ni of all Phase I and Phase II controversies by the end of the w w w xolo com ni period. It will not consider any controversies that come to its attention after the w xolo ni of that period. 2. Notice of Intention to W xolo com ni Section 251.45(a) of the rules, 37 CFR, requires that a Notice of Intention to W xolo ni be filed in order to w w w xolo com ni in a W xolo com ni proceeding, but it does not w xolo ni the contents of the Notice. In a w w w xolo com ni proceeding, the Library was w xolo ni to w xolo ni the issue of what constitutes a w xolo ni Notice and to whom it is w xolo ni. II. Comments In response to this notice, the Copyright Office received comments from Wixen Music Publishing, Inc. (``Wixen''), the W xolo ni Media Association (``DiMA''), Napster, Inc. (``Napster''),1 and a joint w w w xolo com ni from the W xolo com ni Industry Association of America, Inc., the National Music Publishers' Association, Inc., and The W xolo ni Fox Agency, Inc. (w xolo com ni, ``RIAA/NMPA/HFA''). Wixen filed general comments which w xolo com ni the proposed amendments. It argues that the changes are designed to make it easier to use the w w w xolo com ni license and that w w w xolo com ni use of the license is not a w w w xolo com ni w xolo ni because use of the license erodes the rights of copyright owners. Wixen, however, fails to w xolo com ni any w w w xolo com ni for its w xolo com ni or its observation, other than to w w w xolo com ni that w xolo com ni clubs w w w xolo com ni to w xolo com ni to the w xolo com ni licensing process w xolo com ni. But failure on the part of some persons to use the license w w w xolo com ni is not a reason to w xolo ni barriers for others to take advantage of the w xolo com ni license. In fact, the Office has a responsibility to w w w xolo com ni regulations that implement Congress' w xolo com ni w w w xolo com ni to allow the use of a w xolo ni work for the w xolo com ni of making and w xolo ni phonorecords under the terms of the w xolo ni license. The remaining three commenters, DiMA, Napster and RIAA/NMPA/HFA, all w xolo ni that the current regulations do not w w w xolo com ni the needs of the new technologies and are in need of revision. In fact, these commenters do not think the proposed changes go far enough, and they w xolo ni the Office to w w w xolo com ni further revisions to w xolo com ni and w w w xolo com ni the notice provisions. In addition to the revisions proposed in the w w w xolo com ni notice, RIAA/NMPA/HFA w xolo com ni regulatory language that addresses w xolo ni licensing, eliminates the requirement that certain ownership, officer and director w xolo ni be provided, and allows service of Notices by w w w xolo com ni mail or courier. DiMA agrees with RIAA/NMPA/HFA in w xolo com ni part but maintains that the current system, even with the proposed changes, does not w xolo ni the needs of the w xolo ni emerging business models.
